As an Australian Apprentice, you must be paid under the relevant trade award, the National Training Wage Award, an individual agreement, an Australian Workplace Agreement or a Certified Agreement. Your wage will vary according to your age, how long you have been out of school, how long you have been an Australian Apprentice and other factors.
Your employer will inform you of the employment conditions you will be working under including whether the Australian Apprenticeship is full time or part time. You will generally be subject to the same employment conditions as other employees. However, you and your employer are also subject to the conditions of the Training Contract.
When you start your Australian Apprenticeship, you will go through a probationary period. During this period, either you or your employer can cease the Australian Apprenticeship by giving notice under the relevant Award or Employment Agreement.
For traditional time-based apprenticeships, you and your employer must both agree to cancel the Training Contract or suspend it for a specific period. Until you are able to find a new employer your Training Contract is cancelled and your Australian Apprenticeship ceases.
You can also agree to change the provisions of the Training Contract with your employer.
If your employer wants to keep you on as an Australian Apprentice when you want to leave or if you feel you have been unfairly dismissed, you can ask the Office of Training and Tertiary Education (OTTE) to hold an inquiry into the dispute. A delegate of that Office will then decide on the dispute.
